Terms of Service

Welcome to One Accord. These Terms of Service ("Terms") are a binding legal agreement between you ("User," "you," or "your") and Kruzich Media LLC ("One Accord," "we," "us," or "our"), governing your access to and use of the One Accord mobile application (the "App").

By downloading, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.

These Terms also serve as the end user license agreement ("EULA") between you and us for the App, and they incorporate the additional Apple-specific terms set out in the "Apple-Required Terms" section below. Where these Terms apply to an App obtained through the Apple App Store, they apply in place of, and are intended to satisfy, the minimum terms required by Apple for a custom EULA.

1. Eligibility

You must be at least 18 years of age to download or use the App. By using the App, you represent and warrant that you meet this age requirement and are legally able to enter into this Agreement.

2. License

We grant you a personal, non-exclusive, non-transferable, revocable, limited license to install and use the App on any Apple-branded product that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, and strictly in accordance with these Terms. You may not:

- Reproduce, modify, distribute, or create derivative works based on the App;

- Reverse-engineer, decompile, disassemble, or otherwise attempt to extract the source code of the App, except to the extent that this restriction is prohibited by applicable law;

- Use the App for any illegal or unauthorized purpose;

- Use the App in a manner that could interfere with, disrupt, or negatively affect other users;

- Transfer, redistribute, or sublicense the App, or make it available over a network where it could be used by multiple devices at the same time.

If you sell or give away your Apple device, you must remove the App from it first.

3. User Conduct and Community Standards

You agree to use the App only for lawful purposes and to treat other users with respect. You agree not to:

- Upload, post, or transmit any content that is unlawful, offensive, harassing, hateful, or sexually explicit;

- Harass, threaten, abuse, stalk, or impersonate others;

- Misrepresent your identity, age, marital status, or intentions;

- Solicit money, promote commercial activity, or use the App for any purpose other than genuine personal connection;

- Use the App in a way that could damage, disable, or impair the App's functionality or interfere with any other user's use of the App.

4. Objectionable Content and Zero Tolerance

We have zero tolerance for objectionable content and abusive behavior. You can report or block any other user directly within the App. We review reports and may remove content, restrict features, or terminate accounts — typically within 24 hours of becoming aware of a violation. By using the App, you agree that we may take these actions at our sole discretion to keep the community safe.

5. Interactions With Other Users

You are solely responsible for your interactions with other users. We do not conduct criminal background checks or otherwise verify the identity, statements, or intentions of any user. We do not guarantee any matches, relationships, or outcomes. Use caution and good judgment, especially when sharing personal information or meeting anyone in person. Meet in public places and tell someone you trust where you are going.

6. Fees

The App is currently free to use. Certain features may be unlocked through in-app actions (such as referring other users). If we introduce paid features in the future, they will be offered as in-app purchases processed by Apple through your Apple ID account, subject to Apple's Media Services Terms and Conditions, and we will not collect or store your payment card details. Refunds, where available, are handled by Apple at https://reportaproblem.apple.com.

7. Intellectual Property

All content, trademarks, logos, and intellectual property in the App are owned by or licensed to us and are protected by copyright and other intellectual property laws. Your use of the App does not grant you any ownership or rights in the App or its content beyond the limited license provided in Section 2. You retain ownership of the content you submit, but grant us a license to host, display, and share it as needed to operate the App.

8. Third-Party and External Services

The App may contain links to, or enable access to, third-party websites or services and external services (collectively, "External Services"). We are not responsible for examining or evaluating the content, accuracy, terms, or privacy practices of any External Services, and we shall not be liable for any such External Services. You agree to use External Services at your own risk and in compliance with their applicable terms. We reserve the right to change, suspend, remove, disable, or impose access restrictions on any External Services at any time without notice or liability.

9. Termination

We reserve the right to suspend or terminate your access to the App at any time, without notice, if we believe you have violated these Terms or our community standards. Upon termination, all rights granted to you under these Terms will immediately cease, and you must delete the App from your device.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUIET ENJOYMENT, AND NON-INFRINGEMENT. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY US SHALL CREATE A WARRANTY.

ONE ACCORD IS A PLATFORM FOR MEETING AND COMMUNICATING WITH OTHER PEOPLE. WE DO NOT WARRANT OR REPRESENT THAT USE OF THE APP WILL RESULT IN ANY MATCH, RELATIONSHIP, MARRIAGE, OR OTHER OUTCOME, OR THAT OTHER USERS ARE WHO THEY CLAIM TO BE.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON A CONSUMER'S STATUTORY RIGHTS, SO THE ABOVE EXCLUSIONS AND LIMITATIONS MAY NOT APPLY TO YOU.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY PERSONAL INJURY OR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, BUSINESS INTERRUPTION, OR DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE APP OR YOUR INTERACTIONS WITH OTHER USERS, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.

12. Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in any way connected with your use of the App, your interactions with other users, your violation of these Terms, or your violation of any applicable law or the rights of a third party.

13. Apple-Required Terms

The following terms apply to your use of the App obtained through the Apple App Store. In the event of any conflict between this section and the rest of these Terms with respect to the App on Apple devices, this section controls as to the subject matter it addresses.

a. Acknowledgement. These Terms are concluded between you and Kruzich Media LLC only, and not with Apple Inc. ("Apple"). We, not Apple, are solely responsible for the App and its content. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.

b. Scope of License. The license granted to you for the App is a non-transferable license to use the App on any Apple-branded product that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

c. Maintenance and Support. We are solely responsible for providing any maintenance and support services for the App, as specified in these Terms or as required by applicable law. You acknowledge that Apple has no obligation to furnish any maintenance and support services for the App.

d. Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.

e. Product Claims. We, not Apple, are responsible for addressing any claims relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

f. Intellectual Property Rights. In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

g. Legal Compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

h. Developer Name and Address. Any questions, complaints, or claims with respect to the App should be directed to: Kruzich Media LLC, Beaumont, California, USA, [email protected].

i. Third-Party Terms of Agreement. You must comply with applicable third-party terms of agreement when using the App.

j. Third-Party Beneficiary. You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

14. Updates and Modifications

We may update these Terms from time to time. If we make material changes, we will notify you by updating the "Last Updated" date and, where appropriate, by providing in-app notification. Continued use of the App after changes means you accept the revised Terms.

15. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Riverside County, California, for any legal proceedings related to these Terms or your use of the App.
